Terms and Conditions

By accessing or using Timegram, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Timegram is a mobile application that lets you create projects, run a timer against them, and review the time you’ve logged across projects and days. Timegram is designed to work entirely offline: all of your projects and time logs are stored locally on your device, and Timegram does not offer cloud sync, backup, or multi-device access.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to use Timegram. By using the App, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or legal guardian.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Timegram on a device that you own or control, solely for your personal, non-commercial time-tracking purposes. This license does not grant you any right to:

• Copy, modify, or create derivative works of the App;
• Reverse engineer, decompile, or disassemble the App, except to the extent such restriction is prohibited by applicable law;
• Rent, lease, lend, sell, redistribute, or sublicense the App; or
• Remove, obscure, or alter any proprietary notices on or within the App.

You agree not to use Timegram to:

• Violate any applicable law or regulation;
• Attempt to gain unauthorized access to any part of the App, or to any systems or networks connected to it;
• Interfere with or disrupt the integrity or performance of the App;
• Introduce viruses, malware, or other harmful code through the App; or
• Use any automated means (bots, scrapers, etc.) to access the App in a manner that sends more requests than a human could reasonably produce.

We may, in the future, introduce optional paid features. If we ever do, we will update these Terms accordingly before any such feature becomes available, and existing free functionality will not retroactively require payment.

“Your Content” means the projects, timer sessions, time logs, profile name, and any photos you create or add within Timegram. As between you and us, you retain all ownership rights in Your Content. Because Your Content is stored locally on your device and is never transmitted to us, we do not host, access, or control it, and we have no ability to view, back up, or recover it on your behalf. You are solely responsible for safeguarding your device and Your Content, including making any backups you may want, since uninstalling the App or losing your device will permanently delete Your Content along with it.

Timegram uses Firebase Analytics and Firebase Crashlytics, services operated by Google, to help us understand aggregate usage and diagnose crashes, as described in our Privacy Policy. Your use of the App is also subject to Google’s own terms governing those services. We are not responsible for the availability or performance of third-party infrastructure that the App relies on.

The App, including its design, graphics, logos, icons, and underlying software, is owned by Ashtec Apps and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved by Ashtec Apps.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA STORED WITHIN THE APP WILL NOT BE LOST OR CORRUPTED, INCLUDING AS A RESULT OF DEVICE FAILURE, OPERATING SYSTEM UPDATES, OR UNINSTALLATION.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASHTEC APPS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE APP IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED TEN U.S. DOLLARS (USD $10). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Ashtec Apps and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your violation of these Terms or your misuse of the App.

You may stop using Timegram at any time simply by uninstalling it. We may suspend or terminate your license to use the App if you violate these Terms, or discontinue the App altogether at our discretion, with or without notice. Because the App does not use accounts, “termination” on our end would generally take the form of discontinuing the App or a specific version of it, rather than disabling an individual account.

We may update, modify, or discontinue features of the App at any time. We may also revise these Terms from time to time; if we do, we will update the “Effective date” at the top of this page. Your continued use of the App after a revised version of these Terms becomes effective constitutes your acceptance of the changes.

These Terms are governed by the laws of the jurisdiction in which Ashtec Apps is established, without regard to its conflict-of-law principles, except to the extent mandatory consumer-protection laws of your own country of residence apply and cannot be waived.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ashtec Apps regarding the App, and supersede any prior agreements on this subject. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
